STANDARD TERMS AND CONDITIONS

1. Undertaking

1.1 Tshomo Divine Travels (Pty) Ltd (“the Company”) undertakes to provide all services offered subject to the Terms and Conditions set out herein.
1.2 These Terms and Conditions shall apply to all bookings, services, and agreements entered into with the Company.

2. Definitions

2.1 “Company” means Tshomo Divine Travels (Pty) Ltd.
2.2 “Partner” / “Client” means any international travel agent, DMC, incentive house, MICE company, or entity making use of the Company’s services.
2.3 “Traveller(s)” means the end clients of the Partner making use of the services.
2.4 “Services” means all travel-related arrangements including accommodation, transport, tours, and related services provided by the Company.
2.5 “Suppliers” means third-party service providers including hotels, transport providers, guides, and activity operators.

3. Nature of Business

3.1 The Company operates as a Destination Management Company (DMC).
3.2 The Company acts as an agent for third-party suppliers and provides ground handling services.
3.3 The Company shall act as an extension of the Partner’s services and shall not directly engage the Partner’s clients for business purposes.

4. Booking & Confirmation

4.1 All bookings must be submitted via email to .
4.2 A formal quotation will be issued based on the information provided.
4.3 Bookings are confirmed only upon:

  • Written acceptance of the quote
  • Submission of completed booking form
  • Receipt of required payment

4.4 The Company reserves the right to withdraw or amend any quotation prior to confirmation.

5. Pricing

5.1 All rates are quoted on a nett (non-commissionable) basis.
5.2 Prices are quoted in USD ($) unless otherwise stated.
5.3 Rates are per person sharing, unless otherwise specified.
5.4 Single supplements apply where applicable.

5.5 Prices are subject to change due to:

  • Exchange rate fluctuations
  • Fuel price increases
  • Government taxes or levies
  • Supplier rate changes

6. Payment Terms

6.1 A 40% deposit is required to confirm bookings.
6.2 The balance is due 7 days prior to travel.
6.3 Bookings made within 14 days require 100% upfront payment.

6.4 Payments must be made via:

  • Bank transfer
  • Secure payment link

6.5 The Company reserves the right to cancel services if payments are not received on time.

7. Cancellation Policy

7.1 All cancellations must be made in writing.

7.2 Cancellation fees (based on total package value):

  • 30–15 days prior: 25%
  • 14–8 days prior: 50%
  • 7–3 days prior: 75%
  • 2 days or less: 100%

7.3 Supplier-specific cancellation policies may apply and will override the above where applicable.

8. Amendments

8.1 Amendments to confirmed bookings are subject to availability.
8.2 Amendment fees may apply.
8.3 Any additional costs arising from amendments will be for the Partner’s account.

9. Accommodation

9.1 Accommodation is based on two persons sharing, unless otherwise specified.
9.2 The Company reserves the right to substitute accommodation with similar or higher standard where necessary.

10. Transport

10.1 Transportation is provided via vehicles suitable for the group size.
10.2 The Company reserves the right to adjust vehicle type based on operational requirements.

11. Luggage

11.1 One suitcase and one carry-on bag per traveller is permitted unless otherwise stated.
11.2 The Company is not responsible for loss or damage to luggage.

12. Travel Documentation & Health

12.1 It is the responsibility of the Partner and Traveller to ensure:

  • Valid passports (minimum 6 months validity)
  • Required visas
  • Vaccinations and health requirements

12.2 The Company shall not be liable for any consequences arising from failure to comply.

13. Insurance

13.1 Travel insurance is strongly recommended for all travellers.
13.2 The Company shall not be liable for any losses that could have been covered by insurance.

14. Delays & Force Majeure

14.1 The Company shall not be liable for delays caused by:

  • Weather conditions
  • Flight delays
  • Strikes
  • Political unrest
  • Acts of God

14.2 Any additional costs incurred due to such events shall be for the Traveller’s account.

15. Liability

15.1 The Company acts as an agent for Suppliers and shall not be liable for:

  • Injury, loss, or damage
  • Supplier failures
  • Service disruptions

15.2 The Company shall only be liable in cases of proven gross negligence.

16. Right of Admission

16.1 The Company reserves the right to refuse service or terminate services if a Traveller:

  • Acts unlawfully
  • Disrupts operations
  • Endangers others

17. Itinerary Changes

17.1 The Company reserves the right to amend itineraries where necessary.
17.2 Alternative arrangements of equal value will be provided where possible.

18. Refunds

18.1 No refunds will be issued for unused services.
18.2 Refund requests must be submitted in writing within 30 days of travel completion.

19. Supplier Terms

19.1 All services are subject to Supplier terms and conditions.
19.2 By confirming a booking, the Partner agrees to these Supplier terms.

20. Protection of Personal Information (POPIA)

20.1 The Company complies with the Protection of Personal Information Act (POPIA).
20.2 Personal information will be used only for service delivery and shared with relevant suppliers.
20.3 The Company will take reasonable steps to protect all personal data.

21. Confidentiality

21.1 Both parties agree to maintain confidentiality of:

  • Pricing
  • Client data
  • Business practices

22. Governing Law 22.1 This agreement is governed by the laws of the Republic of South Africa.
22.2 All disputes shall fall under South African jurisdiction.
